Litigation Rates

Workers’ Compensation

Minnesota law governs the fees charged by an attorney in recovery of benefits for an injured worker. Payment of your attorney is contingent upon success in that representation.

  1. If the representation is limited solely to litigation of payment of a medical bill,
    and we obtain payment of the medical bill, our fee is paid directly by the insurance company.

  2. If we represent you to obtain wage loss benefits or benefits relating to a permanent injury, then our fee is based on a contingent fee. If we are successful, then our fee is 25% of the first $4,000.00, and 20% of the next $60,000.00 recovered. This effectively limits the attorney’s recovery to $13,000.00, unless there are exceptional circumstances. However, to claim fees in excess of $13,000.00, the attorney must obtain approval from the Court.

If we are successful, our costs are typically paid by the insurance company
